Sexual Harassment Policy

A.  Definition:  Sexual harassment of an employee is a violation of Title VII of the Civil Rights Act of 1964.  Title IX of the 1972 Education Amendments broadens this behavior to cover students.  Sexual harassment consists of any unwelcome verbal or physical conduct of a sexual nature where submission to such conduct is an explicit or implicit term or condition of employment.  With regard to students, sexual harassment is defined as any behavior of a sexual nature that denies, limits or adversely affects the emotional well being or academic progress of any student enrolled at that institution.  In addition, any unwelcome sexual conduct that unreasonably interferes with an individual’s performance or creates an intimidating, hostile or offensive working environment can constitute sexual harassment even if it leads to no tangible or economic job consequences.  Sexual harassment under any of the above definitions is a violation of school policy at Faulkner State Community College and will not be ignored, tolerated or condoned.
B.  Grievance Procedure:  If an individual is confronted with what he or she considers to be sexual harassment, several courses of action are available. They are:
•  taking personal action either in person or by letter stating that the behavior is neither humorous, nor welcome, and should cease immediately;
•  request informal third-party mediation from a friend or colleague;
•  file a formal grievance in accordance with the College’s Title IX Grievance Procedure.  Copies of the College’s Grievance Procedure are available in the President’s Office and all of the Deans’ offices.  Any student with a complaint or grievance should contact the Dean of Student Services, Memorial Hall, telephone (251) 580-2122.
C.  Questions:  Questions concerning sexual harassment regarding faculty and/or staff should be referred to the Director of Human Resources or the Dean of Instruction/Dean of Workforce Development and Technology.
D.  Student Grievances:  The Dean of Student Services has been designated the College’s complaint/grievance officer.  Any student who wishes to file and/or pursue a complaint or grievance should contact the Dean of Student Services, Memorial Hall, telephone (251) 580-2121.
